The list of types of professions subject to the job vacancy posting requirement, updated by the DEFR every year in the fourth quarter, is published in an ordinance of the DEFR and is valid from January 1 to December 31 of the following year. The only criterion that determines whether a type of profession is subject to the posting requirement is the respective unemployment rate. The individual rates are calculated at the national level on the basis of a 12-month average for the types of professions in the Swiss Nomenclature of Occupations of the Federal Statistical Office (FSO).

The 2021 list already reflected the increase in the unemployment rate caused by the coronavirus pandemic. As a result of this increase, the number of types of professions that reach or exceed the five percent threshold for the posting requirement has increased slightly again for 2022.

In 2022, five additional types of professions will be subject to the posting requirement, for a total of approximately 213,000 employees. By far the largest of the new types of professions subject to the requirement is salespersons and assistants (approximately 158,000 employees), whose unemployment rate reached 5.3 percent in the reference period. Job vacancies for advertising and marketing specialists, graphic and multimedia designers, varnishers and painters, and tourism consultants and operators will also have to be posted.
